Most people who walk in after a crash ask the same two questions. Am I actually hurt? And who pays for this? We'll leave the first one for the exam. This post is about the second, because in Utah the answer is clearer than most people expect.
Your own PIP pays first
In Utah, injury care after a crash starts with your own Personal Injury Protection, or PIP. It pays your medical costs no matter who caused the accident, so you don't have to wait for the other driver's insurer to accept fault before you get care.
Under Utah Code 31A-22-307, PIP pays the reasonable value of necessary medical, rehabilitation and related services, with a minimum of $3,000 per person. Many policies carry more. Your declarations page shows your limit.
What "reasonable value" means
PIP doesn't pay whatever a provider decides to charge. Utah's insurance commissioner runs a relative value study of what services cost in the state's most populous county, and PIP pays up to the 75th percentile of those charges. In plain terms, there's a standard price list behind PIP, and it's set by the state, not by the clinic or the insurer.
PIP pays more than medical bills
The same statute also covers part of the income you lose while you're injured and an allowance for household help you can't do yourself. Those benefits have their own limits and waiting periods, so ask your insurer about them when you open your claim.
When you can go beyond PIP
PIP is the first payer, and for many people it's the only one. Utah law (31A-22-309) lets you bring a claim against the at-fault driver for general damages only when your injury crosses a threshold:
- medical expenses over $3,000
- a bone fracture
- permanent disability or impairment based on objective findings
- permanent disfigurement, dismemberment or death
If your care is likely to go past your PIP limit and someone else was at fault, talk to a personal injury attorney. That's not something a chiropractor should advise you on, and we won't pretend otherwise.
Why the timing matters
Whiplash often doesn't show up right away. Symptoms can take hours, or even weeks, to appear after a collision. Waiting until it's obvious can mean starting care late and having less documentation on file from the days right after the crash. If you want the medical side of that in more detail, read the hidden dangers of minor car accidents.
